Muscles and Macros Summer Challenge Terms & Conditions

The dates to enter the Muscles and Macros Summer Challenge (“The Challenge”) run from May 20 to June 10, 2019 at 11:59 pm MST.

How To Enter
To officially enter The Challenge, Participant must complete a Summer Challenge Registration purchase online at JessieFitness.com/summer-fitness-challenge-2019/. Participant’s purchase and the registration form Participant fills out (link to registration form will come via email after registration purchase is complete). Participant must complete the entry form themselves. Only one entry per Participant will be accepted; all preceding entries will be disregarded. False, deceptive or incomplete entries provided by Participant shall render the entry ineligible.

Participant must have a registered user account on JessieFitness.com with The Challenge registration purchase in Participant’s own account to be eligible to win The Challenge. Additionally, to enter and complete The Challenge, Participant must submit the following (via the provided link emailed after registration purchase is complete) at the beginning and end of The Challenge:

  • Upload (via the link in your email receipt) 1 full-length digital photo taken from the front. Women should wear a sports bra and shorts or similar..
  • In your photo you must hold up a piece of paper (8.5″ x 11″ minimum size) with the #JESSIESGIRLS hashtag written on it and the current month and year. Your card MUST be clearly legible and NOT a mirror reflection. If your card is too small, blurry, ink too light, etc, you may be disqualified.
  • Feel free to be YOU in your front-view photo (flex, smile, etc)! Just make sure you are posing the same in your before and after photos for each position.
  • Finding a spot with good lighting and a non-cluttered, neutral background is highly recommended.

The entry period for submitting “Before” photos and information will begin on May 20, 2019 at 12 pm MST and end on June 12, 2019 at 11:59 pm MST.
Upon completion of The Challenge, the period for submitting “After” photos and information will begin on August 31, 2019 and end on September 3 at 11:59 pm MST.

Jessie Fitness, Inc is not responsible for internet connectivity, email delays or lost entries.
All submissions shall become the property of Jessie Fitness, Inc and Participant grants to Jessie Fitness, Inc the exclusive right to use all materials submitted by Participant including any videos, photos, name, city and state of Participant’s residence, testimonials, essays, statements, images and likenesses and to reproduce, edit, distribute, publish, broadcast, modify, copyright, and otherwise exploit in any manner those materials in the marketing and promotion of Jessie Fitness, Inc products without further payment or consideration. Participant’s submission of the entry form constitutes Participant’s agreed consent to the grant of the rights hereunder.

Jessie Fitness, Inc shall not return any tangible copies of Participant’s submissions to the Challenge and shall not be responsible for any loss or damage thereof. Participant acknowledges receiving adequate consideration from Jessie Fitness, Inc in exchange for the rights granted.

How Winners Will Be Selected
The Challenge judges will be made up of Jessie Fitness, Inc.’s staff and Jessie’s Girls Ambassadors. They will select winners based on a combination of the biggest visual and lifestyle transformations. A total of three (3) winners will be selected:

  • 1 Grand Prize Winner
  • 1 1st Place Winner
  • 1 2nd Place Winner

Winners of The Challenge will be announced between September 6th and 9th, 2019.

Who’s Eligible to Enter the Challenge?
The Challenge participants must be at least 18 years of age. Participants from any country may enter The Challenge.

All Challenge entrants, including international residents, are eligible to win the cash prizes as as follows: $1000 Grand Prize, $400 first place prize, and $100 2nd place prize.

Participants and Winners must have a valid United States mailing address to receive any apparel, supplement, or tangible prizes.

The Challenge is subject to applicable country, federal and state laws and is void where prohibited.

Regulations and Requirements
Jessie Fitness, Inc reserves the right to interpret these rules and, if necessary, to amend the rules at its sole discretion. All information and materials submitted become the sole and exclusive property of Jessie Fitness, Inc.

Each participant in The Challenge assumes all risk of injury, harm or loss of any kind arising from participation. Consult with your physician or health care provider before starting any new exercise, nutrition or supplementation program, particularly if you suffer from any medical condition or regularly use prescription or over-the-counter medications. Participants in The Challenge expressly indemnify and hold Jessie Fitness, Inc, its distributors and affiliated companies, and the directors, officers and employees of any of them harmless from all risk, loss, injury, damage or harm that may arise from participating in The Challenge and consuming any products that the participant may use during The Challenge.

Participant represents and warrants that they are in good health and in proper physical condition to participate in the Challenge. It is Participant’s sole responsibility to determine whether they are sufficiently fit and healthy enough to participate in the Challenge.

Any communication regarding The Challenge will be sent to the e-mail used to register on the registration web page. It is Participant’s responsibility to notify challenges@jessiefitness.com of a change of e-mail address or any change to Participant’s registration. Winners who cannot be reached or do not respond within three (3) days at the email address provided will be disqualified.

All winners are responsible for all applicable taxes; prizes are not transferable; and there will be no substitutions for the prizes except at the option Jessie Fitness, Inc in the event of unavailability. All winners may be required to sign any documentation requested by Jessie Fitness, Inc., including, without limitation, an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form, declaration and release form confirming compliance with the Challenge rules, acceptance of the prize as awarded and releasing Jessie Fitness, Inc and its affiliates, directors, agents, representatives, successors and assigns from any liability in connection with The Challenge. Winners shall be required by law to pay any applicable local, state and federal taxes, and any other charges including, but not limited to, duties, customs fees or other fees, on prizes. A 1099 Form will be filed with the IRS of the United States.

Refund Policy
You are entitled to a refund prior to downloading your Jessie’s Girls ebook provided you email help@jessiefitness.com stating the reason for your refund on or before June 8, 2019. Jessie Fitness, Inc does not offer refunds once we are two days from the Challenge beginning and/or you have downloaded your Jessie’s Girls ebook.

Miscellaneous
Participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Challenge, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration to be conducted in Maricopa County Arizona; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Challenge but in no event attorneys’ fees; and (3) under no circumstances will Participant be permitted to obtain an award for, and Participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, or the rights and obligations of Participant and Jessie Fitness, Inc in connection with the Challenge, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Arizona, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Arizona. If any provision in these Challenge rules are held to be invalid or void the remainder of the Challenge rules shall still be in force. Jessie Fitness, Inc is not responsible for any incorrect or inaccurate entry information, human error, technical malfunction, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, access providers, or software, including any injury or damage to your or any other persons’ computer relating to or resulting from participation in this Challenge; inability to access the entry website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entry submissions that are processed late or incorrectly or are incomplete, garbled, or lost due to computer or electronic malfunction or traffic congestion on the Internet or any website. Participant agrees that proof of entering information on the website is not considered proof of Jessie Fitness, Inc.’s delivery or receipt.

By entering The Challenge, participant agrees to release and hold harmless Jessie Fitness, Inc, its related companies, and their respective officers, directors, shareholders, employees and agents, as well as the individual judges, from and against any claim or cause of action arising out of your participation in the challenge, including without limitation any claim for infringement of intellectual property rights, personal injury, or receipt, possession, use or misuse of any prize. Jessie Fitness, Inc is not responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participating in the challenge or receipt or use of any of the prizes. all federal, state, provincial and local laws and regulations apply.
Jessie Fitness, Inc reserves the right to cancel or modify this challenge for any reason including, without limitation its convenience or if fraud, technical failures or any other factor beyond Jessie Fitness, Inc.’s reasonable control impairs the integrity of the challenge as determined by Jessie Fitness, Inc. in its sole discretion. Any disputes arising from or relating to the challenge or the selection of winning submissions will be resolved by Jessie Fitness, Inc.
